how do you know your car with exhaust won't pass? catback exhausts have to meet noise level requirements but that's not tested at the smog station. You could pass smog with an aftermarket exhaust. I had a custom straight through exhaust with no resonator and I passes smog, well barely, but I did (with other mods). What kind of exhuast do you have? Can you put the stock back on, or was it a weld job? You might want to put your stock airbox back on if you have an Intake that's not smog legal in your state.
I'd do it legit.
The techs who get caught doing that stuff go to jail and pay something like $25,000 , and so I wouldn't want to get caught up in that in any way.

I get my kicks on EC.
