Ian from Carexcess.com is in the run with my money

Ian from Carexcess.com is in the run with my money and many others. Heres the story, I got the VDC kit from Carexcess.com back in November in a GB that PhatCellyGt was running. Every time I would call Carexcess I got the same story that they are still waiting for parts from Decah. Finally, after 2 months of numerous calls I got to speak to Ian. Ian would always tell me that I was on the top of his list and he would have it out soon. This was his same story for about another 2 months. When finally last week he said he got it in and it was definitely going to get shipped today and he would have the Tracking # ready for me when I called. For my surprise I gave Carexcess a call today and Kelly an ex-employee of Carexcess picks up the line and says that Ian came to the shop over the weekend and took off with everything except for that phone. All the money and all the orders are gone. They have no records of any orders because he also took the computers. I was like WHAT THE FUCK ARE YOU TALKING ABOUT. She then says that I should call my bank immediately and request my cash back. I called my bank right after that and they come out with a stupid policy that they can only dispute your purchase if its been less than 90 day. Im soooo pissed and for the people that know me Im a very patient customer but this is really fucked up. angry I just got assed out $1500. I just checked the website www.carexcess.com and it's also down. Any suggestions?

I really appreciate all the support guys. This is whats happened after I posted this thread. I contacted Carexcess again and this time some guy named Jerry picked up the line. He claims to be Kellys husband and Ians partner. Well, at least until he fucked him over also. 1. A police report has been filed on Ian for fraud and stolen property because according to Jerry, Ian also took off with all the tools from the shop which didnt even belong to him. This is all the information I could get on the police report. 2. This guy Jerry is going to take over the company on Friday but under a new name, no longer Carexcess. This is sooo strange and now I noticed that the website www.carexcess.com is back up and running. 3. According to Jerry this guy Ian fucked over a lot of people. Including 3 major companies that order 15 VDC kits at $2000 a piece and 2 group purchase for s2000 and RSX with over 16 members strong which most of them have already paid in FULL. This guy really took off with a lot of cash.

As for my $1500 Im going to go to my bank personally tomorrow and demand them to return my cash or at least look into the situation its ridiculous that the only thing they have to say to me over the phone is It doesnt really matter that this guy committed fraud because its been over 90 days. What kind of customer service is that? They could at least make me feel better by saying that they are going to look into the issue. Jerry even said he is even willing to testify. I guess I will have more information tomorrow.

I went to my bank yesterday and explained the situation to them but its useless my bank isnt going to do anything about the situation. I HATE MY BANK AND THEIR STUPID POLICIES.

However, I did give Carexcess a call yesterday to speak to Jerry and explain to him what the bank had told me and to my surprise Ian answered the phone. I WAS LIKE WHAT THE FUCK IS GOING ON HERE. Ian explained to me that he had to close down the shop because he was unable to pay his bills and they were going to be evicted on Wednesday and he had no choice but to close. However, all the calls are now being forward to a new #. Luckily I work for a Telecom Company and I could find out if this is true. I just checked the Carexcess # and in fact it is being forward to another location. He claims that Jerry and his wife got into the shop on Monday and started to pick up the phone calls and telling everyone that he committed fraud. He claims this is false and that they are just upset because of his decision. He stated that he is suing Jerry and Kelly for slander. However, he is advising everyone to do cash back with their credit card companies because they are not completing any new orders and the people in my situation that cant do a cash back because 90 days have passed, he will credit us back or going to complete the VDC kit and have it out to us ASAP but he has to wait for approval from his lawyers. He said to give him a call on Friday. What Im afraid of is that Ian is going to file bankruptcy and screw everyone over. Any advice?

When you start a corporation you need to
1) Have your first corporate meeting
2) Issue stock
3) Have corporate resolutions
4) Elect officers of the company
5) Have a partnership agreement.

I have never ran a corporation before because before we were just a sole proprietorship. Now Jerry has ran 2 body shops in the past (I found this out later) Both of which went bankrupt... If I had known I would have made better decisions about having him as a partner. Anyway... Business went from June 15th 2003 to February 15th before i noticed that there was a problem with a major problem in the finances. The partnership arrangement was I was in charge of sales and the web site. Kelly was in charge of charging the customers, book keeping, and office management. and Jerry was in charge of the work getting done.

When i had noticed the problem in February I notice that there was a lot of miss appropriation of funds in the company by the book keeper and hired a CPA (Public Accountant) to take a look at the books to see where we were and help me find where the money was going. It was then in March that I had to lay off 6 employees because there was not enough money to pay the employees. It was then in late March and early April that I started getting calls from creditors while i was at the office and at home that the bills had not been paid. I asked Kelly (the book keeper) why they had not been paid and she stated that there was no money. Which leaves me asking again... where did it all go...

All in all the run down is this.
1) Because we as a partnership did not do anything that a partnership is suppose to do... meaning the 5 things listed above means that we never functioned as a partnership. Meaning we are still the sole-proprietorship and I am left with the debt of the entire company and Jerry is left with owing nothing.
2) The company is not shutting down. The web site will still be running and kits will still be sold. We are working with lawyers to
find if we should
a) Shut down entirely
b) Just operate the web site
c) find a different location

Once we know the direction we will be taking we will be letting all customers know. This decision will be made sometime early next week. NO CUSTOMERS WILL BE "SCREWED" OVER. The people that will be ... will be me and my wife that will be loosing everything we have in order to make sure that all liabilities are paid off.

I hope you all understand what I have put here and ask anyone with any comments to call me because I definitely am not running away from anything. Jerry and Kelly would just like you to believe that so he can ruin the Car Excess name.

Why not try to be more simple about things wave

5. Have a Contingency Plan

I spoke to Ian on the phone on Monday and there is basically nothing more to do but wait until his lawyers advice him on his next step. I feel that they are going to advice him to file for bankruptcy whether it be Chapter 11 (Carexcess attempting to reorganize) or Chapter 7 (Company is generally worthless) In my opinion, Carexces customers are going to get assed out because we will only get a percentage to the dollar of the amount we paid for the product. Not only that but we have to wait until the whole filing is complete just to file a claim. The time frame that customer are looking at is mid through end of July. If you dont consider this SCREWED, then what is?

Ya know, I actually took my celica to Carexcess this past november and had my Decah Lambo hinges installed right there on the spot! I dealt with Ian for the 6 hours I was there at the shop and everything about it was legit. I also met Jerry towards the end of my visit there in Tampa and he was also very compitent and willing to answer any questions I had. I'm really sorry you had such problems w/carexcess, they did ME right.

dude i am sorry to hear that but if they file for bankrupcy they don't have to pay you untill they get some revenue, even if you sue them they screw you till they have made a profit .keep us update on your story...
